This form is a Creditor's 'Proof of Claim.' The form contains the following categories basis for claim, date the debt was incurred,and instructions for the proof of claim form.

The form contains types of contracts and leases like a rental lease for where the debtor lives, cell phone contracts, lot rental agreements, land purchase/sale contracts, home owners association contracts, pager contracts, auto leases, renttoown contracts, realtor listing agreements, and internet contracts.

This form is Schedule E. The form contains types of priority claims. Some the priority claims include deposits by individuals, contributions to employee benefit plans, and wages, salaries, and commissions. 

This form is Schedule D. The form contains the following categories creditor's name and mailing address; date claim was incurred; amount of claim; and unsecured portion, if any. 

This form is Schedule C. The form may be used to list information concerning exempt property. The form contains the following categories description of the property; value of the claimed exemption; and current market value of the property.

This form is Schedule B. The form may be used to list information concerning types of personal property; description and location of personal property; and the current market value of the debtor's interest in the property.

This form is Schedule A. The form may be used to list information concerning the description and location of real property; the nature of the debtor's interest in the property; and the amount of the secured claim.

This form is used to indicate as to each schedule whether that schedule is attached and the number of pages in each.  It is used to report the totals from all schedules and determines the total amount of the debtors assets and debtors liabilities.

This form is used when a bankruptcy court has approved an order for payment of filing fees in installments.

This form is used for individual debtors who are unable to pay the filing fee in full at the time they file the bankruptcy petition.

At whatever point the lender has no further use for the report, and it may be difficult to know when this occurs, you should request that the report be sent to you or destroyed so that it does not end up in a trash receptacle or other public area to be picked up by an identity thief. To help you estimate when to request the report, use these guidelines. If credit is denied, request the report immediately at the time of denial. If credit is extended, then wait approximately six months to request the report.

The Notice to Creditors is a written request to creditors of an estate to present their claims to the personal representative of the decedent.

This Notice to Creditors is sent by the Attorney or the Personal Representative of the deceased person's estate. The Notice provides all interested parties the chance to notify the Personal Representative of their claim against the remaining assets of the estate or appear in court and present their claim. The Notice is typically published in the official county newspaper for the county where the probate is filed.

This Notice is published to ensure that all unknown creditors have an opportunity to present their claims to the estate.

This letter is used to request a copy of a credit report file from a credit bureau.

If you have been denied credit or if other adverse actions regarding your credit have been taken based on your credit report, you may want to obtain a copy of your credit report and verify the information contained in it.

The purpose of the Request for a Credit Report letter is to assist you in obtaining a copy of your credit report, particularly if you have been denied credit, employment or insurance within the last 60 days.

The credit report tells how you have managed credit in the past and companies examine your credit report before deciding whether to give you new credit. You can request a copy of your credit report by sending a letter to a credit reporting bureau.

When you receive your credit report you should carefully review it. You have the right to respond to a negative entry on your report, to have errors corrected, or to have your response made part of your credit report.

The purpose of this letter is to correct an unauthorized change to your mailing address. If you discover that your credit card statement is being sent to another address that you have not authorized, you need to correct the problem immediately by contacting your credit card company. An unauthorized change to your mailing address may be indicative of identity theft and, as such, you should review your statement very carefully for unauthorized charges or transactions.

This letter is used to communicate with your credit card company to cancel your credit card account because you are unsatisfied with the new terms of your account.

Credit card companies periodically change the terms of your account. The changes generally take place automatically unless you do something to stop them. The Letter to Cancel a Credit Card because of Poor Terms allows you to notify your credit card company that you are unsatisfied with the new terms and directs the company to cancel your account. Some credit card companies will negotiate the terms.

This is most likely to occur over an annual fee charge. Many credit card companies will waive the fee rather than lose your account. You may also want to cancel your account or attempt to negotiate over other changes in the terms of your account, such as an increase in the interest rate or a change in your credit limit.

Be sure to check your credit card agreement for the credit card company's rights after you close the account. By law, the company can not charge an annual fee if you notify them of your intent to close your account within the time specified in the notice. If you attempt to use the card after the cancellation date, however, most credit card companies provide that such use constitutes acceptance of the new terms.

If you intend to cancel the card, be sure not to later attempt to use it. If you have an outstanding balance at the time that you cancel the credit card, the credit card company may be able to charge you a different rate if it is specified in your agreement or in the notice of changed terms.

Never give your card number over the telephone unless you initiated the transaction with a reputable company. If you have questions about a company, check with the local consumer protection office or Better Business Bureau before ordering.

This letter allows you to request the reasons why your application for credit was denied or why your existing account was terminated. You may also use this letter to correct any incorrect information which has caused an unfavorable change in your account.

This Debt Settlement Agreement is a contract used to finalize negotiations between debtors and creditors. It defines the amount owed and the date by which payment will be made.

The Debt Settlement Agreement defines the original amount owed, the final amount to be paid as agreed by all parties, and the last date for payment to be made. Optional sections in this agreement cover liability and confidentiality as well.

When you receive your credit report, you should review it carefully for any mistakes and information that is more than seven years old ten years for bankruptcy. If you do not understand something, ask. The credit bureau staff is required by law to explain your report to you.

Correcting Mistakes If there is a mistake or you wish to challenge an incorrect entry in your credit report, use this Challenge to a Credit Report letter. You have a right to have your response to a negative entry on your report made part of your credit report. Usually the credit bureau will advise you to contact the party that provided the negative information directly.

If there are mistakes, you can take the following actions 
Notify the credit bureau of the problem by using this letter. Provide as much information as you can about what is wrong with the report. The credit bureau must investigate the disputed information at no charge to you. The credit bureau must correct any mistake or delete any information it cannot verify. It may be helpful to contact the creditor directly to ensure that the creditor's records are correct. If the above steps do not resolve the problem, you can file a written statement of up to 100 words with the credit bureau providing your explanation of the problem. This explanation will be included in your credit report.

Copy of the Credit Report If possible, provide the credit bureau with a copy of the actual credit report, identifying the incorrect or challenged entry. There are instances in which you may not have a copy of the report. In such cases, identify the parties, the nature of the account, the outstanding balance on the account, and the nature of your complaint so that it can be easily identified.Respond to the negative entry in your credit report file by explaining why the entry is incorrect. For example, explain that the outstanding balance is incorrect or payment has already been made. Provide all information which might be relevant and useful to the credit bureau when investigating your complaint.

Federal law provides specific rules that the card issuer must follow in responding to suspected billing errors. The card issuer provides a statement describing these rules when the account is opened, and additional notices at least once per year. Many card issuers print a summary of your rights on each monthly statement.

Use this letter to notify a bank or credit union that you want to stop payment on a check. This letter is commonly sent when a check has been lost or misplaced by the recipient and you are asked to reissue a new check.

The United States Bankruptcy Code is a federal law that permits qualified debtors to
discharge some or all of their debts in exchange for giving up all of their nonexempt assets, or reorganize their debts in an attempt to pay them back under relaxed terms.

A bankruptcy may be voluntary initiated by the debtor or involuntary initiated by the creditors. To begin a voluntary bankruptcy, the debtor files a petition in the United States Bankruptcy Court. Upon filing the petition, the debtor receives an automatic stay which orders creditors to pause in their collection efforts during the bankruptcy process. The debtor must file detailed information with the bankruptcy court identifying all assets, debts and creditors. All creditors must be notified of the bankruptcy so that each creditor can file notice of its claim with the bankruptcy court.By filing the petition, the debtor permits the creation of the bankruptcy estate which includes all of the debtor's assets, except those assets that the debtor successfully claims as exempt those that are necessary so that the debtor can live and work. The rules for determining what property becomes part of the bankruptcy estate are complex. A courtappointed bankruptcy trustee administers the estate.

There are several different types of bankruptcy to choose from. Each type is referred to by the Chapter of the Federal Bankruptcy Code in which it appears. In general, a Chapter 7 bankruptcy results in a sale of all of the debtor's nonexempt assets, but most debts are then discharged. In a rehabilitation case filed under Chapters 11, 12, or 13, the debtor retains his assets and makes payments to the creditors, usually from the postbankruptcy earnings, pursuant to a courtapproved payment plan which is more relaxed than it had been before bankruptcy.

The purpose of the 401k Rollover Request is to advise the administrator of a 401k plan that an account balance should be rolled over into an IRA or another retirement plan. Typically, this would occur when an employee leaves an employer because of either retirement or job termination.

Generally the plan administrator will provide several options, one of which will be the transfer of the current account as a direct rollover to an IRA or another retirement plan a Recipient Plan. The direct rollover option has the following advantages.

If your current account balance is paid directly to you, the distribution will be taxable to you, and you will likely have to pay income taxes. Further, if you receive the distribution prior to age 59 and 1/2 years, you will also have to pay an additional 10 percent tax, unless you qualify for a hardship exception. Thus, the direct rollover allows you to continue the deferral of income taxes on your account.It is possible to handle a rollover by taking a distribution of your account directly to yourself, and then rolling over all or a portion of it to an IRA or another retirement plan within 60 days after you receive the distribution. You defer income taxes on any amount that you roll over and pay income taxes on any amount that you retain. The risk of this approach is that you might fail to timely transfer the funds into an IRA or another retirement plan within the 60 days, with the result that you pay income taxes on the entire distribution. The direct rollover avoids this result by having the funds go directly from your current plan to the new account. If you want a partial distribution and are willing to pay the taxes, you can take a partial distribution from the new account.

The 401k Rollover Request form addresses only the safe option of requesting a direct rollover. Your plan administrator may advise you that you must make your request using the plan administrator's preprinted form. If you are locked into that approach and want to make a direct rollover request, carefully fill out your administrator's form, and in addition, complete this program's request form and give it to your administrator as a supplemental document.
