Transportation example refers to an example whereby a contractor supplies transportation and related services of goods. Under this Transportation example, Service Provider is also known as the Carrier and Service Recipient is also referred to as Broker. Service Provider is an independent contractor, who desires to furnish Motor Carrier service to Broker for the transportation of general commodities. This example can be used for sale of services from a business to another business or individual.
This Shipping example refers to agreements to transport goods from one destination to another by land, water or air. Through this example you can engage a shipping company (“carrier”) to transport your goods to a certain destination after you and the carrier agree upon transit and pricing requirements. This example emphasizes the timely delivery of goods and supplies the client with an option to cancel the order or receive compensation in the event of a delay.
In this example, the Carrier performs its services in accordance with the highest industry standards. Further, the Carrier is given sole and exclusive control over the manner in which Carrier and its agents perform the Shipping Service provided for hereunder, and Carrier can utilize such individuals as it may deem required in connection therewith upon an understanding that such individuals shall be subject to discharge, discipline, and control solely and exclusively by Carrier.
You should remember to attach as “Exhibit A” a document that contains a description of the goods to be shipped and their respective weight.
This document should not be used if the Carrier is an individual. A Work for Hire, Consulting example, or Subcontract or example documents can be used for that purpose. This document only deals with services purchased from a business, and therefore, does not address issues related to independent example or status.
The basic elements of a Shipping example are:
Identification of the parties. A description of the services to be performed. The dates or scheduled dates for Efficiency of the services. Any conditions or limitations placed on either of the parties or warranties related to the Efficiency of services. Payment terms.
